End-User License Agreement (EULA)

1. Introduction & Acceptance

This Agreement governs your use of all Punch Rescue hardware and software, including Rescue Cards, Repeaters, Alert Stations, Raft Devices, the Punch Rescue mobile application, and web-based dashboard (collectively, the “Application and Hardware”). By downloading, installing, activating, or using any Punch Rescue hardware or software, you agree to be bound by these terms.

2. License Grant & Restrictions

Punch Rescue grants you a limited, non-exclusive, non-transferable license to use the Application and Hardware for your internal or personal use. You may not reverse engineer, tamper, circumvent security, or use for illegal purposes.

3. Ownership & Updates

All rights remain with Punch Rescue. We may update firmware, the Application, and dashboard features without notice.

4. Data Privacy & Protection

Punch Rescue is committed to protecting your data. Our Privacy Policy (below) explains how we collect, use, share, and safeguard information, including breach notification and compliance with GDPR/CCPA.

5. Disclaimers & Limitations

The Application and Hardware are provided “AS IS” to individual end users. Liability is limited to $50 for individuals. Enterprise customer rights prevail where applicable.

6. Termination & Modification

Punch Rescue may suspend or terminate access for violations. Terms may be updated with notice via the Application, website, or email.

7. Governing Law & Venue

North Carolina law governs this Agreement. Exclusive jurisdiction lies in Mecklenburg County, NC.

Privacy Policy (Punch Rescue)

1. Scope

Applies to all Punch Rescue hardware and software users.

2. Data We Collect

– Personal identifiers (name, email, phone, organization)
– Device, hardware, and usage data (IP, logs)
– Location data (with consent)
– Emergency and alert communications (messages, logs)

3. Use of Data

– To deliver and enhance services
– To provide support and troubleshooting
– To comply with legal and regulatory requirements (GDPR/CCPA)

4. Sharing & Security

– No sale of data
– Shared only with authorized service providers under strict obligations
– Encryption, access controls, and monitoring employed

5. Breach Notification

Punch Rescue will investigate, notify affected users (per GDPR 72-hour rule and applicable laws), and take remedial measures.

6. GDPR/CCPA Rights

Users can access, correct, delete, or port data and opt out of certain processing.

7. Retention

Data is retained only as necessary, then securely deleted or anonymized.

Data Breach Response Policy (Public Summary)

  1. Detect and confirm breaches via monitoring and reporting.
  2. Contain the breach and secure systems.
  3. Assess the scope and type of data impacted.
  4. Notify affected parties and regulators per law (GDPR 72-hour rule).
  5. Provide guidance to users (e.g., password resets, credit monitoring if appropriate).
  6. Remediate vulnerabilities and publish post-incident findings.

Support Policy

Support Hours: 08:00–20:00 ET, Monday–Friday; 24×7 emergency support for Severity 1 issues.

Response Times: 1 hour for Severity 1, 4 hours for Severity 2, next business day for all others.

Channels: Email, phone, in-app chat.

Punch Rescue may adjust policies with 30 days’ notice.

Acceptable Use Policy

Users must not engage in illegal activity, interfere with systems, upload malware, circumvent security, use for spam, impersonate others, or exceed reasonable usage limits. Violations may result in suspension or termination without notice.
